Terms of Service

These terms are an agreement between website10x ("website10x", "we", "us") and the business that creates a website10x account ("you"). They cover the website10x app, the websites you build and host with it, the AI that builds and edits them, forms and the Inbox, the AI assistant for website chat, calls, and texts, phone numbers, and related services (the "Services"). By creating an account or using the Services, you agree to these terms on behalf of your business, and you confirm you're authorized to do so.

1. Your account

2. Plans, trials, and AI credits

Plans

You can use the Free plan for as long as you like, within its limits. Paid plans have a monthly or yearly fee, billed in advance, and renew automatically until you cancel. Each plan's price and allowances are shown on our pricing page and in your dashboard.

Trials

Paid plans may start with a free trial. What's needed to start one, and when it ends, is shown before you start. Unless you cancel before a trial ends, your subscription starts when it ends.

AI credits and allowances

Your plan includes allowances, such as AI credits for building and editing, website chat replies, call minutes, text replies, form answers, storage, websites, and people. AI credits refresh each billing month and don't roll over. When credits run out, AI features pause until they refresh, unless you buy more. Usage of the assistant beyond your plan's allowances, such as extra call minutes or text replies, is charged at the rates shown for your plan and added to your next invoice. You can see your allowances and usage in your dashboard.

Taxes

Prices don't include taxes. You're responsible for applicable taxes, and we'll add them to invoices where we're required to collect them.

Late or failed payments

If a payment fails, we'll let you know so you can update your payment method. If it isn't resolved, we may move your account to the Free plan or suspend paid features, including the assistant and phone numbers, until it is.

Changes to prices

We may change prices, allowances, or rates. We'll give you at least 30 days' notice by email or in the app, and the change will apply from your next billing period after the notice. If you don't agree, you can cancel before it takes effect.

3. Cancelling

4. Your websites and content

5. AI features

6. Calls, texts, and email

You're responsible for how you use website10x to communicate with people, and for complying with the laws that apply, including Canada's Anti-Spam Legislation (CASL), the U.S. Telephone Consumer Protection Act (TCPA), privacy and call recording laws, and carrier rules for business texting. In particular, you agree to:

7. Phone numbers

Phone numbers website10x provides are obtained through our telecommunications providers and are for use with the Services. If your plan no longer includes them or your account is closed, those numbers may be released. If you'd like to keep a number, contact us first and we'll help where our providers allow.

8. Your data

9. Acceptable use

You agree not to:

10. Third-party services

The Services rely on providers such as Anthropic, Twilio, Stripe, and our hosting providers. Their services are subject to their own terms. We're not responsible for outages or changes on their side, though we'll work to keep the Services running.

11. website10x's property

website10x and its licensors own the Services, including the software, design, templates, and trademarks. We give you a limited, non-exclusive, non-transferable right to use the Services for your business while your account is active. If you send us feedback, we may use it without obligation to you.

12. Suspension and termination

We may suspend or close your account if you materially break these terms, don't pay, or use the Services in a way that risks harm to people, our providers, or the Services. Where reasonable, we'll give you notice and a chance to fix the problem first. Sections that by their nature should survive, such as fees owed, your data, disclaimers, and limits of liability, survive termination.

13. Disclaimers

The Services are provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee the Services will be uninterrupted or error-free, that AI output will be accurate, that every call will be answered, or that every message will be delivered.

14. Limitation of liability

To the extent the law allows, website10x won't be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, customers, or data. website10x's total liability for any claims relating to the Services is limited to the amounts you paid website10x in the 12 months before the event giving rise to the claim.

15. Indemnity

You'll defend and indemnify website10x against claims by third parties arising from Your Data, your websites' content, your communications with your customers (including consent and opt-outs), or your breach of these terms or the law.

16. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, and the courts of Ontario have exclusive jurisdiction.

17. Changes to these terms

We may update these terms. We'll post the new version here with a new date and, for significant changes, notify you by email or in the app at least 30 days before they take effect. Continuing to use the Services after that means you accept the updated terms.

18. General

These terms and our Privacy Policy are the entire agreement between us about the Services. If part of these terms is unenforceable, the rest still applies. Not enforcing a right isn't a waiver. You may not transfer this agreement without our consent; we may transfer it as part of a merger, acquisition, or sale of assets. Neither of us is responsible for delays caused by events beyond reasonable control.
